Description

A cartulary written chiefly in the latter part of the thirteenth century with later additions and insertions. Labelled on spine 'C Liber Evidentia'. On page 51 is a near contemporary transcription of Magna Carta. On page 62 is a grant by Henry III of all amercements for the building of the new Cathedral dated 23rd March 1227. On page 97 is a copy of a charter dated 2nd July 1218 recording the removal of the Cathedral from its previous location (now known as Old Sarum) to its current location. Several leaves and quires at the beginning and end contain miscellaneous additions including copies of constitutions and Chapter Acts 1320-1326. 282 folios. Listed below is a contents list of documents 1 to 132 (compiled by Penelope Rundle with dates added by Chancellor Christopher Wordsworth between inverted commas) and documents 133-362 (compiled by June Effemey). Witnesses to the charter include Richard, Bishop of Sarum and A, Treasurer of Sarum. 13th April 1221 335 237-8 Charter involving Hubert, Bishop of Sarum church (1183-1194) and William, Abbot of Shirborn/Syreburn, concerning the prebend of Shirborn and the land of Kingeston. Grant to Hubert, the Bishop of Sarum, of the church of Hagestoke, as a prebend, in honour of God and the glory of the Virgin Mary. The charter notes the poverty and indigence of the Monastery of Shirborne; thus the grant by Bishop Hubert to them of the churches of Stapilbrig, Stokes and ?Coristube. 12th century 336 238-9 Ordination of the vicars of Stapilbrig and Stoke, involving ?Jordan, Dean of Sarum, Hubert, Bishop of Sarum, and Hugo of Reading [Abbey]. Due to the poverty and indigence of Shirborn monastery, the revenues/fruits of the churches of Stapilford and Stokes are granted to them. The manuscript gives the date of the charter as 6th June 1211, but this seems to be erroneous as Liber Evidentiarum B gives the date as 1191, and both Jordan and Hubert were 12th century clerics at Old Sarum. 337 239 Charter involving the Abbot of Shirborne ‘Syreburn’ and Bishop Hubert of Sarum; grant to the Bishop and his successors and to the church of Sarum of the church of Halgestoke, for the honour of God and the glory of the Virgin Mary, for a prebend there. Also the grant of Lyme church. Misdated as 1211 (Liber Evidentiarum B dates this charter to 1191). 338 239-240 Charter concerning Stephen, the rector of Brichtwalton and the Abbot and convent of Bello Loco (Beaulieu) and tithes of hay, wool, cheese, chickens, a dovecot, and 25 acres of land of a croft in the ville of Brichtwalton. Charter made at Reading, 1224, possibly 28th June 1224 339 240 Charter involving Bishop Jocelin of Bath, Alan Bassett, the Prior and canons of Berencester, Richard, Bishop of Sarum, and W, Dean of Sarum, concerning the church of Compton. The Bishop of Sarum has the advowson of the church of Cumpton in perpetuity, and the parson of the church has one third of the tithes there. Circa 1220-3 340 241-2 Charter stating that Radulphus Belet, knight, is permitted to have a chapel, paid for by himself, in the church of Frum (Frome). A portion of the tithes of Wardeford are to pay to renovate it, and divine services are to be celebrated in it. 1221 341 242-3 Charter involving Amesbury Priory, Ivychurch Priory, the Dean of Wilton, Stanlee Abbey and the Bishop of Sarum. The matter is between Master Roger, precentor of Sarum on the one part and Master Richard de Wirthe on the other part, concerning tithes of land in Kingland, which is situated in the parish of Westbury, which of old was a prebend of the monastery of Wilton. Charter of Richard, Bishop of Sarum, and the Prior and Convent of Bromore, and their giving up their rights in the church of Candel to monasteria Ederosa = Ivychurch Priory. The sum of 5 marks sterling to be paid at the 4 terms of the year as rent. Half of the document is held by Ivychurch and half by the church of Sarum. The Prior and Convent of Bromore assigned a rector to the church. Kalends of May 1224 345 244-5 Agreement between Phillip de ?Orcicumbe, chaplain, and Abraham the treasurer of Sarum about the chapel of Wanbroke in the prebend of Cherdestoke; public recognition of this agreement is given in the Chapter of Sarum. Witneesses to the charter include H, Dean of Sarum, T, the sub-dean, and others. 1220s 346 245 About Henlegh (Henley) church. Charter of Dni Herbert de Luci, knight, addressed to Bishop Robert of Sarum (Bingham 1228-1247) and W, Dean of Sarum, and the Chapter of Sarum; inspeximus of the grant, by Herbert de Luci, of the church of St Mary, of Henley, at a rent of eleven shillings sterling per annum, to Richard de Maupudre, canon of Sarum (1226/7-1233). 347 245 Indulgencia indulgence. Charter of Bishop Jocelin of Bath, involving Bishop Richard of Sarum on the one side and the abbot and Convent of Glastonbury on the other, concerning a papal indulgence of Honorius III, of which a transcript was appended to the original charter, and is here written out, about the receipt of the fruits/revenues of several churches, for six years, for the monks of Glastonbury. ?Early 13th century. 348 245-6 Charter of Jocelin, Bishop of Sarum (1142-1180); grant by W, son of A de Potterne to J[ordan], the Dean (1176-1193), and the chapter of Sarum, of half of the land of Azonis, brother of W, with the agreement of Azonis, as well as two manages, tenements/mesuages, one of which is located in Poterne and the other in Witona. Annual rent includes half a pound and a pinch of pepper, or half a pound of incense, for all services rendered. Witnesses included Jordan, Dean of Sarum, and others. Dated between 1176 and1180. 349 246-7 Case/process between Bishop Jocelin of Sarum and William, son of Alexander, about lands held by Alexander in Poterne and Canning from the lord Bishop. The case concerns half the land of Azonis, excepting 2 managus (tenements, messuages); the capital messuage is in Wrtona (Worton) Azoretaus and the other messuage W has is in Poterne. Rent of half a pound of pepper and half a pound of thuris incense is due as rent per annum. The reeve of the Bishop holds some land relevant to the case; others involved include Roger, son of Evardi, friend of Azonis and W. The petition of Azonis and W resulted in a pact with the Bishop. 1173 350 247 Charter of Jordan, Dean of Sarum; ratification of an agreement between Bishop Jocelin of Sarum, and William, son of Alexander of Poterne concerning lands in the soke of Potterne and Canning. Late 12th century 351 247 Charter of Dean Jordan of Sarum concerning a dispute between Bishop Jocelin and W[illiam], son of A[lexander] about half the land of Azonis, his brother, in Poterne, and about two messuages of Azonis, which are to be excepted from any agreement, as well as about rent of pepper and incense. It is agreed the land is to be held by the Bishop and his successors. Late 12th century 352 247-8 Prebend of Bedmyster (Bedminster). Charter of Gilbert de Lacy, canon prebendary of Bedminster; grant to the women lepers next to the bridge of Brichtviebrig their own chantry chapel cantarium suam. The women are only admitted to the celebration of divine office in the prebend of Bedminster with their household chaplain, and are to be faithful and obedient to the church of Bedeminster. Lepers are everywhere to have campanas manualis handbells. No bodies of the lepers to be buried in the cemetery at a time when the chapel is in use. Lepers are admitted to Bedminster chapel on certain feast days, such as Christmas, Easter, and the feast of St John. On St John’s day and other feast days, the women are to receive monies collected. The leper women are granted land, with its liberties and appurtenances, in Bedminster, in perpetuity, that is land which John, brother of Osmund and Robert held, and granted and gave as a donation to Thomas de Berkeley, founder of the hospital of the lepers. Confessions of the household of the leper women to be held annually in the chapel of Bedminster. Benedictions for the lepers to be held at least three times a year, including on the feast of St John, Christmas Day, Easter, and the feast of Purification. The leper women are to receive bread. The leper hospital was founded by Thomas de Berkeleya. Various edicts given to Bedminster about the lepers, and their funding within the prebend and church of Bedminster. Those not fulfilling these instructions are answerable to the chirch of Bedminster and the Treasurer of Sarum. Seal of Gilbert de Lacy was attached to the original charter. 12th century? 353 248-9 Charter of Bishop Jocelin, concerning the prebend of Shirborne and Abbot Henry and the convent of St Mary, Shirborne, that is Sherborne monastery. In memory of St Osmund, tithes of the parish church of Sherborne, which the church of Sarum possesses, are granted to Sherborne Abbey. Also concerned in the charter are half of the land which lies in Winburnam, once held by Evramari, son of ?Baiocar, which King William gave to the church of Horton, in exchange for land granted to Sarum church, according to the customs of the church of Sarum, now granted by Sherborne to Sarum. Peace and charity between Sarum and Sherborne thus brought about. 12th century (check with photos taken of this charter to get a clearer sense) 354 249 Agreement between H (Herbert or Hubert), Bishop of Sarum, and Reginald de ?Laci and Roger de ?Breng, which the Bishop made by way of conciliation. Grant of land for 7 years to de Laci and Roger. The Bishop in return is given 200 oves muncese/murtres, sheep/ewes and two multones muttons. Witnesses include Jocelin de Poterne, Luca de Canning, Roger son of Eduard, William de Cocis. Late 12th century 355 249-50 Agreement between Walter dispensator de Worton and Alice his wife and Philipp their son on the one side and Baldwin, Walter Dispensator’s son. Baldwin is to have the minor tithes of all Walter’s lands and all the parish of W, both land of the brother and the saltings of Kyhavene, the homage and the wheat given to his brother William. The charter is concerned with dividing up of Walter’s lands among his family, including his mother and father, and the rents due on these lands. Circa 12th century. 356 260-1 Final concorde/agreement made in the court of the Lord King at Wesminster. Herbert the Bishop of Sarum, petitioner, and Roger, son of Everard, tenant of 5 hides of land in the manor of Ramesbury and land in Mimbury in the manor of Poterne and in the manor of Lavington and in Hurst, on the south side of the ditch. Part of the land remains with the Bishop and part remains with Roger, son of Reginald (sic). The boundaries between the land ‘metas’, to be repaired. Payment by Roger to the bishop include oats avene and two knight’s services. Monday in the 7th year of Richard, 3rd June 1196 357 251 Concorde made in the King’s court in Westminster, in the presence of the Archbishop of Canterbury and the Bishop of Ely. Agreement between Herbert, Bishop of Sarum and Jocelin and Walter, tenants, about two virgates of land in the manor of Old Sarum, which the Bishop claims to be in his demesne. The tenants quitclaim one virgate of land, situated next to Old Sarum. The other virgate of land is an old feoffment which is the property of the Castle of Sarum ‘castello Sarr’, on the east side, next to the leper house, to be held from the Bishop, in perpetuity, paying to the Bishop 12d per annum. Thursday after the Feast of St Martin, 1195 =/- 16th November, 7th year of Richard I 358 251-2 Final agreement, made in the King’s court in Westminster, in the presence of the Archbishop of Canterbury, the Bishop of Ely and others, as in entry 357. Herbert, Bishop of Sarum, petitioner, and Peter, son of Symon, tenant, concerning half a hide of land and 2 acres of land in Lavington. Peter quitclaims the half hide of land to the church of Sarum and to the Bishop, and retains the 2 acres, paying two shillings per annum rent. 16th November 1195 359 252 Case about Potterne, held in the King’s court, Westminster. Bishop Herbert of Sarum vs William Nigitti concerning one virgate of land and a mill in the manor of Poterne, which the Bishop claims to be in his demesne, and a place/site placitus, which lay between them. Peter quitclaims the properties, and all charters and muniments pertaining to them, to the Bishop, and in return received 10 silver marks. Thursday on the Feast of St Martin, 16th November 1195 or 1196. 360 252-3 Final concorde, made in the court of the King, Westminster. The case was between Herbert, Bishop of Sarum, and William de Perci, petitioner, and concerned the ville of Cerdestoke. William quitclaims his right to land in the ville to the Bishop and his successors and in return receives 20 marks silver and the grazing for one horse/warhorse dextar depasco. Thursday after the Feast of St Edward the King, ?1195 or1196. 361 253 Case about Eastdene, held in the King’s court at Wilton. The case is between Edith, daughter of D/Hyward, petitioner for Alice her daughter, and Dean Richard and the Chapter of Sarum and concerned fifty quinquaginta acres of land and four messuages in East Dene. Edith recognizes the right of the church of St Mary, Sarum, and the Chapter, in this land and in return she receives one messuage and a croft in Eastdene, paying 2 shillings rent annually at the feast of St Michael. Tuesday after the octave of the Apostles Peter and Paul, in the 4th year of the reign of King John = Tuesday 9th July 1202. 362 253-4 Case held in the king’s Court, Westminster, concerning petitioner Hamelyn, son of John, and Bishop Herbert of Sarum and one virgate of land in Tisted, which Hamelyn quitclaims to the Bishop, and receives 5 silver marks in return. 10th June 1202
