Description
Articles of agreement between Roger Kay Rector of Fittleton in the county of Wiltshire (for and on behalf of Mr William Ashton [Assheton] Rector of Prestwich in the county of Lancaster [Lancashire] clerk and proprietor of certain lands in Tylshead [Tilshead] in the county of Wiltshire) of the one part, and James Wadhams senior of Tilshead yeoman and farmer of the said lands of the other part. Roger Kay agrees that James Wadhams or his assigns shall hold all the lands in his possession of the said Mr Assheton at Tilshead, for the full term of 8 years from 29 Sep 1720. James Wadhams agrees to hold the lands for the said term and to pay Mr Assheton the annual rent of £38 2s 6d upon Michaelmas day. He agrees to serve all offices charged on him, to pay the window tax, to keep the glass windows, the thatching of the house, barns and outhouses, together with the hedges, bounds and fences in good repair, and to yield them up to Mr Assheton at the expiration of the term. Mr Assheton agrees to allow out of the rent yearly taxes except the windows, and to allow James Wadhams the quitrents of the little living and one cottage. He also agreed that if either party shall design at the end of 8 years to part one from another, that party will give to the other a year's notice, and at the year's end the premises to be free to Mr Assheton's disposal. James Wadhams shall have liberty to leave the estate at the expiration of 4 years provided he gives a year's notice. The witnesses were Dorothy Kay and John Weston.
